Fourth Schedule of the Indian Constitution contains provisions related to the allocation of seats in the Council of States or Rajya Sabha. This Schedule contains the number of seats represented in the Rajya Sabha from each State and Union Territory. Schedule 4 deals with Articles 4(1) and 80(2).

  • Indian Constitution's fourth schedule has changed over the years, and it is briefly detailed below:
  • Rajya Sabha was to have 217 members when the Constitution was approved in 1949, of which 12 were to be nominated by the President, and the remaining 205 were chosen to represent the States.
  • Rajya Sabha was to have 216 members when the Constitution went into effect on January 26, 1950; 12 of those members would be presidential nominees, and the other 204 would be elected representatives of the States.
  • With the passage of the States Reorganisation Act of 1956, the Bihar and West Bengal (Transfer of Territories) Act of 1956, and the Andhra State Act of 1953, the Fourth Schedule was modified.
  • The States Reorganisation Act of 1956, the Bihar and West Bengal (Transfer of Territories) Act of 1956, and the Andhra State Act of 1953 all changed the Fourth Schedule.
  • In 1954, there were 204 elective seats overall; in 1956, there were 207 seats total; and in 1970, there were 220 seats in total (addition of thirteen seats).
  • The Fourth Schedule was also modified each time a new state was created or a change was made to existing legislation.
  • Finally, there are currently 245 members, of which 233 are from the States and Union territories, and 12 are presidential nominees.
