Article 167 imposes on the Chief Minister the responsibility of keeping the Governor informed of all decisions made by the Council of Ministers concerning administration and legislation. He is required to provide the Governor with any and all information requested by him in these matters. Article 167 corresponds to Article 78 in terms of the Prime Minister's obligation to keep the President similarly informed.

Article 167 mentions the following duties of the Chief Minister:

  • If the governor so directs, to submit to the council of ministers any matter on which a minister has made a decision but which has not been considered by the council.

  • As a result, the Governor must have complete authority to be kept informed of legislative decisions.

  • The Governor is not required to accept the advice of a Minister (or Chief Minister) and may request that the matter be brought before the entire Council of Ministers.
  • Also, under article 164(2), the Council of Ministers' responsibility to the Legislative Assembly is collective.
    • If an important decision is made by a Minister without the matter being considered by the Council of Ministers, the Governor may request a referral to the Council of Ministers under article 167(c).
  • If the Minister's decision is confirmed by the Council, the Governor cannot veto it.
  • According to the Sarkaria Commission, article 167 grants the Governor "persuasive and not dictatorial powers to override or veto the decisions or proposals of the council of ministers."
