  • The Supreme Court has ordered that transgender people be classified as socially and economically backwards.
  • The Supreme Court ordered the central and state governments to implement social welfare programmes for the transgender population and to raise awareness among the general public in order to eliminate the stigma associated with their culture, belief, religion, and gender.

Key Features Aspects of the Transgender Persons Act

Key Features Aspects of the Transgender Persons Act

The key features of the 2019 Transgender Persons Act are listed below:

  • The act defines a transgender person as one whose gender does not match the gender assigned at birth, which includes those who have intersex variants.
  • The bill states that transgender people are entitled to equal rights in both school and employment and that no one may discriminate against them.
  • Additionally, the bill guarantees that all transgender people would have access to medical services.
  • A transgender person may request a certificate from the District Magistrate as identification.
  • Additionally, the bill makes it clear that any transgender discrimination or transgressions may result in harsh penalties, including in some cases imprisonment.
Way Forward

Way Forward

  • The formation of the National Council for Transgender Persons, which aims to raise awareness and instil a culture of respect and acceptance for transgender people, is a positive move.
  • However, whether the council is able to identify the difficulties encountered by the transgender population and provide appropriate advice to the government depends on how well it functions.
  • Apart from legislation and regulations, an inclusive approach is required, with legal and law enforcement systems, in particular, being made more aware of transgender concerns.
Conclusion

Conclusion

We hear the word "human rights" a lot in India, but seeing transgender people treated as if they aren't human is terribly distressing. It is past time for us, as human beings, to create a society that is inclusive of all genders and treats everyone equally.
