State Information Commission is a quasi-judicial body, established by the state government under the provisions of the Right to Information Act (2005). Accordingly, all the states have constituted the State Information Commissions through Official Gazette Notifications. The State Information Commission is a powerful independent authority that investigates complaints and makes decisions on appeals. It hears complaints and appeals related to state government agencies, financial institutions, public sector companies, and so forth.

The State Information Commission is an important topic for Prelims 2023 preparation and UPSC Mains 2023 as well.

Composition

State Information Commission - Composition

  • The State Information Commission consists of a State Chief Information Commissioner and not more than ten State Information Commissioners. 
  • The Governor appoints the commissioners on the advice of a committee that includes;
    • Chief Minister as Chairperson, 
    • The Leader of the Opposition in the Legislative Assembly
    • State Cabinet Minister nominated by the Chief Minister
  • Eligibility: They should be prominent figures with extensive knowledge and expertise in law, science and technology, social service, management, journalism, mass media, or administration and governance. 
    • They should not be a Member of Parliament or a member of the Legislature of any State or Union Territory. 
    • They should not hold any other profit-making post, be affiliated with any political party, conduct any business, or practise any profession.
  • Tenure: The State Chief Information Commissioner and a State Information Commissioner hold office for a term of 5 years or until they attain the age of 65 years, whichever is earlier (RTI amendment 2019)
  • Reappointment: They are not eligible for reappointment.
  • Salary and allowance: The pay, allowances, and other service conditions of the State Chief Information Commissioner and a State Information Commissioner shall be as stipulated by the Central Government (RTI amendment 2019)
Removal

Process of removal

  • The Governor can remove the State Chief Information Commissioner or any State Information Commissioner from the office under the following circumstances
    • if he is declared insolvent.
    • if he has been convicted of an offence which (in the opinion of the Governor) involves a moral turpitude
    • Office of Profit: if he engages in any paid work outside of his official duties throughout his time of office.
    • if he is (in the Governor's opinion) unsuitable to remain in office owing to a mental or physical disability.
    • if he has acquired a financial or other interest that is likely to jeopardise his official activities.
  • In addition, the Governor has the authority to dismiss the State Chief Information Commissioner or any State Information Commissioner for proved misbehaviour or incapacity. 
  • In some situations, however, the Governor must send the subject to the Supreme Court for investigation. 
  • If, following the investigation, the Supreme Court supports and recommends the reason for removal, the Governor may remove him.

The powers and functions of the State Information Commission are:

  • It is the duty of the Commission to receive and inquire into a complaint from any person. 
    • who has been unable to file an information request due to the absence of a Public Information Officer.
    • who has been rejected information that was sought; who has not gotten response to his information request within the set time restrictions.
    • Someone believes the costs levied are excessive.
    • who believes the information provided is insufficient, deceptive, or inaccurate.
    • any other aspect connected to acquiring information.
  • If there are adequate reasons, the Commission might order an investigation into any subject (suo-moto power).
  • While investigating, the Commission has the powers of a civil court in the following areas:
    • summoning and enforcing attendance of individuals and requiring them to provide oral or written testimony on oath and to produce documents or items.
    • Document discovery and scrutiny are required.
    • Receiving proof of affidavit.
    • obtaining any public record from any court or office.
    • issuing summonses for the examination of witnesses or documents, and any other thing that may be mandated.
  • During the course of an investigation into a complaint, the Commission may examine any record in the jurisdiction of the public authority, and no such record may be kept from it for any reason. In other words, during the investigation, all public records must be provided to the Commission for scrutiny.
  • The Commission has the jurisdiction to compel public authorities to follow its rulings.
  • Annual Report: The Commission reports to the State Government on the execution of the provisions of this Act on an annual basis. This report is presented to the State Legislature by the State Government.

  • These commissions, like the centre, are overwhelmed with backlog cases.
  • Due to a lack of workers and vacancies that have not been filled, the backlog of cases is growing.
  • However, certain states, such as Mizoram, Sikkim, and Tripura, do not have any backlogs. Even if there are irregularities, the commission's powers are limited to providing information and not taking action.
  • Recently the Supreme Court has directed the Union of India and all States to file status reports on the latest developments regarding vacancies and pendency in the Central Information Commission (CIC) and State Information Commissions (SICs).
