Rule of Law

  • The presence of the rule of law implies that the government belongs to the laws rather than to men.
  • Dicey establishes three essential components of the Rule of Law:
    • No one is to be punished unless a specific breach of law is established in an ordinary legal manner before ordinary courts of law.
    • No oneis above the law.
    • Courts play an important role in protecting an individual's rights and freedoms.

Independent Judiciary

  • The independence of the judiciary is the foundation of any liberal democracy and the essence of a free society.
  • The judiciary is the upholder of the rule of law, and removing its independence jeopardises the entire rule of law.
  • Article 50 of the Constitution also provides for the separation of the judiciary and the executive.

Individual Rights

  • Individual rights must be prioritized in order for constitutionalism to thrive. By enshrining these rights in Part III of the Constitution, India's constitutional framework gives them the weight they deserve.
  • Individual rights have not only been protected by the courts but have also been interpreted in a way that broadens their effect and implementation.
  • The Constitutional Courts, namely the Supreme Court and the High Courts, ensure the enforcement of these rights.

Civilian control of the military

Aside from these characteristics, constitutionalism envisions civilian control of the military so that the military does not interfere in democratic decision-making or attempt a military coup.

Police Accountability

Constitutionalism also envisions the police upholding the rights, freedoms, and dignity of individuals while performing their duties; this can be ensured by bringing the police under the control of laws and courts.
