Which of the following acts broadly related to the digital field, was passed in India in 2023 ?
Digital Personal Data Protection Act
The Digital Personal Data Protection Act, 2023 is the first comprehensive Indian law dedicated to protecting the digital personal data of individuals. Parliament passed it in August 2023 and it received Presidential assent on 11 August 2023. It lays down how personal data may be collected, processed and stored, and it sets up the Data Protection Board of India to hear complaints and impose penalties.
The Act gives rights to the individual, called the Data Principal, such as the right to information about processing, the right to correction and erasure of data and the right to grievance redressal. It places duties on the Data Fiduciary, the entity that processes the data, to take clear and informed consent, to use the data only for a lawful purpose and to protect it with reasonable security safeguards. Penalties for a breach can go up to Rs. 250 crore.
The Information Technology Act is the older law of 2000, amended in 2008, so it was not passed in 2023. The Cyber Security and Fraud Prevention Act and the Digital Service Provider and Intermediary (Regulation) Act are not laws enacted by Parliament in 2023. The proposed Digital India Act, meant to replace the IT Act in future, was still only under discussion at that time.
Hence, Digital Personal Data Protection Act.
