Under which Article of the Indian Constitution the Annual Financial Statement (Budget) is necessary to be laid before the Parliament ?
Article 112
Article 112 requires the Annual Financial Statement to be laid before Parliament — option 3.
What the article says. The President shall cause to be laid before both Houses, in respect of every financial year, a statement of the estimated receipts and expenditure of the Government of India for that year — the Annual Financial Statement. The word “Budget” does not appear in the Constitution at all; it is the popular name for this statement.
The two kinds of expenditure the statement must separate :
| Kind | Treatment | Examples |
|---|---|---|
| Charged on the Consolidated Fund | Not submitted to the vote of Parliament, though it may be discussed | Emoluments of the President; salaries of the Speaker, Deputy Speaker, Chairman and Deputy Chairman; salaries and pensions of judges of the Supreme Court and High Courts; the CAG; debt charges |
| Other expenditure | Submitted as demands for grants and voted upon by the Lok Sabha alone | All ordinary departmental spending |
The neighbouring articles — and each wrong option is one of them, which is why the question is worth care :
| Article | Provision |
|---|---|
| 111 | Assent of the President to bills |
| 112 | Annual Financial Statement |
| 113 | Procedure in Parliament with respect to estimates — demands for grants, and the rule that a demand may be made only on the President’s recommendation |
| 114 | Appropriation Bill — no money may be withdrawn from the Consolidated Fund except under an appropriation made by law |
| 115 | Supplementary, additional or excess grants |
| 116 | Votes on account, votes of credit and exceptional grants |
The corresponding article for a state is Article 202, which requires the Governor to have the annual financial statement laid before the state legislature.
Hence, the answer is Article 112.
