Civil Remedies:

The Trademarks Act prescribes criminal sanctions to deter violations. Offenders may face imprisonment for six months to three years and fines ranging from ₹50,000 to ₹2 lakh. These sanctions emphasize deterrence alongside compensation.

Passing Off safeguards unregistered trademarks and goodwill, focusing on misrepresentation causing consumer confusion. Remedies are primarily civil, including injunctions, damages, and accounts of profits, ensuring protection against unfair competition.

Together, these legal remedies maintain the integrity and commercial value of trademarks, compensating owners, discouraging infringement, and preventing further misuse. They reinforce the importance of intellectual property protection in India, balancing the rights of owners with the need for enforcement mechanisms against unauthorized use.
