Under Article 35A of the Constitution (inserted by the Constitution (Application to Jammu and Kashmir) Order, 1954), the legislature of the State of Jammu and Kashmir was empowered to define who are "permanent residents" of the State and to confer special rights and privileges on them.
This power lay with the State Legislature; the Chief Minister, the President and Parliament did not define permanent residency for the State under that provision.
