Rights Classification by B.N. Rau
The structure of fundamental rights within the Indian Constitution involved specific classifications proposed during its drafting. One key proposal concerned the division of individual rights.
B.N. Rau's Proposal on Rights
B.N. Rau served as the Constitutional Advisor to the Constituent Assembly of India.
He recommended that the rights of an individual be categorized into two distinct types:
- Justiciable Rights: These are rights that are legally enforceable in the courts of law. If violated, individuals can seek legal remedy.
- Non-Justiciable Rights: These rights serve as guidelines or principles for the government. They are not directly enforceable by courts but are fundamental to the governance of the country, often reflected in the Directive Principles of State Policy.
Acceptance by Drafting Committee
The Constitution Drafting Committee considered and accepted this classification suggested by B.N. Rau. This distinction was fundamental in shaping the Chapter on Fundamental Rights and the Directive Principles of State Policy in the Constitution of India.
