 Key Points

  • In a State, the State Legislative Council is considered as the upper house of the State which have a bicameral legislature and the State Legislative Assembly is called as the lower house of the State .
  • At present, there are 6  out of 28 States have a Legislative Council .
  • The member of the Legislative Council (MLC) cannot be more than one-third of the membership of the State Legislative Assembly and its composition cannot be less than 40 members.

  Additional Information

The Member of the Legislative Council are chosen in the following  ways :

  • One-third members of the upper house are elected by members of local bodies -  municipalities, gram sabhas/gram panchayats, panchayat samitis and district councils.
  • One-third members of the upper house are elected by members of Legislative Assembly of the State from among the persons who are not members of the State Legislative Assembly.
  • One-sixth of the upper house are nominated by the governor from the fields such as literature, science, arts, the co-operative movement and social service.
  • One-twelfth members of the upper house are elected by persons who are graduates of three years' standing residing in that state.
  • One-twelfth members of the upper house are elected by persons engaged for at least three years in teaching in educational institutions within the state not lower than secondary schools, including colleges and universities.
