Which Fundamental Right was described by Dr. B.R. Ambedkar as the “Heart and Soul of the Constitution” ?
Right to Constitutional Remedies
The Right to Constitutional Remedies is given in Article 32 of the Constitution of India; it allows a person to move the Supreme Court directly when any Fundamental Right is violated.
Under it the Supreme Court can issue writs of habeas corpus, mandamus, prohibition, certiorari and quo warranto, and the High Courts have a similar power under Article 226.
Because all other Fundamental Rights would be meaningless without a way to enforce them, Dr. B.R. Ambedkar called Article 32 the very heart and soul of the Constitution in the Constituent Assembly.
Hence, Right to Constitutional Remedies.
