Under the Bharatiya Nagarik Suraksha Samhita (BNSS), 2023 (which replaced CrPC), default bail (also called statutory bail or bail by default) is granted when an accused is not charge-sheeted within the stipulated investigation period (60 days for offences punishable with less than 10 years, 90 days for serious offences). The accused can apply for default bail before the Magistrate who is trying or committing the case, and the Magistrate is bound to release the accused if the time limit has lapsed and no charge-sheet has been filed.
