Which Fundamental Right was omitted from Part III by the 44th Constitutional Amendment Act, 1978, and inserted as a Constitutional Right under Article 300A ?
Right to Property
The original Constitution listed seven Fundamental Rights in Part III, including the Right to Property under Article 19(1)(f) and Article 31. Frequent disputes over land reform and compensation led Parliament to change its status.
The 44th Constitutional Amendment Act, 1978 repealed Article 19(1)(f) and Article 31 and added Article 300A in Part XII, which says that no person shall be deprived of his property save by authority of law. Property thus became a constitutional (legal) right enforceable in ordinary courts, not a Fundamental Right.
The Right to Equality (Articles 14–18), the Right to Freedom (Articles 19–22) and the Right to Freedom of Religion (Articles 25–28) all remain Fundamental Rights in Part III, so none of them was moved. Since the omitted right is listed, 'None of the above' does not apply.
