Section 8 of the Hindu Succession Act, 1956 specifies the order of succession for the property of a Hindu male who dies intestate (without a will).
Intestate Succession Order
The property devolves in the following sequence:
- Firstly, upon the Class I heirs.
- Secondly, if no Class I heirs are available, upon the Class II heirs.
- Thirdly, if no heirs from Class I or Class II exist, upon the Agnates of the deceased.
- Fourthly, if no Agnates are available, upon the Cognates of the deceased.

The sequence outlined in Section 8 does not include the government as a heir in the fourth position or any position within this specific devolution scheme.
