Convention Provisions on Sovereign Asylum Right
The Draft Convention on Territorial Asylum, adopted by the United Nations General Assembly in 1974, addresses the right of states to grant asylum.
Article 1 of the Draft Convention explicitly states that the recognition of asylum as a sovereign right of a State, and the conditions under which it may be granted, are matters for every State to determine in accordance with its own legislation and in the light of international instruments relating to refugees and stateless persons.
Therefore, the convention acknowledges that granting asylum is a sovereign prerogative of individual states.
