WBPSC Recruitment 2020: Calcutta High Court levied Fine on State PSC

Calcutta High Court has levied the fine of Rs 10,000 on the Public Service Commission, West Bengal on October 15, 2020. State public information officer (SPIO) was found guilty in a case filed by PCS to challenge the decision of the appellate authority.

On April 12, 2019. The petition was filed for infringement of the right to information act, as Papri Ganguli was not facilitated with the certified copies of answer sheets on multiple appeals.

Justice Abhijit Gangopadhyay stated “SPIO has not only breached the RTI act but also transparency and policy of state by not furnishing answer keys to an applicant. Guilty will have to compensate the applicant within 4 weeks with total cash of INR 10,000.” The judge further stated this illegal practice needs to be condemned as it might lead to more perilous trends in public offices.

Calcutta High Court Found SPIO allegations Baseless

Earlier on February 12, 2018, Papri Ganguli had applied request application with the SPIO to furnish her with certified photocopies of her answer scripts of two papers for the limited departmental examination. The exam was conducted for the promotion of posts by the state government.

Later, The SPIO rejected the request application by Ganguli and refused to facilitate her with photocopies of her answer sheet. Indignant, Ganguli took the matter more seriously and moved to the appellate authority. On April 12, 2019, the appellate authority favored the Ganguli request proposal and ordered the SPIO of Public state commission to provide certified copies of answer scripts to Ganguli.

In response to appellate authority orders, West Bengal PSC moved to the Calcutta High Court and challenged the appellate authority's order. Finally, on October 15, 2020, the court dismissed the plea, finding SPIO guilty. As the high court finds no reason for not furnishing answer scripts to the applicant.

The High Court in the decision on Thursday ordered SPIO to supply the photocopies of the answer scripts to the applicant within four weeks.
